The Fair-Trade Commission’s revised advertising guidelines for social media platforms such as YouTube or Instagram became effective from September 1. However, the guidelines seem insufficient to ban influencers’ undisclosed advertisements which deceive consumers. The new guidelines require influencers to clearly state whether their review posts on social media are financially rewarded, but there is no direct way to impose sanctions on those who violate the guidelines. According to the guidelines, only advertisers who commissioned an advertisement unfairly will be fined. Therefore, practical legal sanctions against social media influencers are needed such as those against advertisers. There are even some YouTubers who upload apology videos to receive even more views, so a substantial sanction is needed to strengthen their responsibilities.
